Terms of Service

TrackFinder USA (trackfinderusa.com) is operated by M&R Legacy Ventures LLC, a Washington State limited liability company (“we,” “us,” or “our”). By creating an account or using the Service, you agree to these Terms of Service (“Terms”). If you do not agree, do not use the Service.

TrackFinder USA is a platform that helps dirt bike riders find tracks and riding venues across the United States. Core features — searching tracks, viewing track details, reading reviews, and checking conditions — are free. Track owners may subscribe to a Pro plan for enhanced listing features.

• You must be at least 13 years old to create an account.
• You are responsible for maintaining the security of your account credentials.
• You are responsible for all activity that occurs under your account.
• You may not share your account or allow others to access it on your behalf.
• You agree to provide accurate registration information and keep it up to date.

You retain ownership of content you submit to the Service, including reviews, condition reports, photos, event listings, and ride posts (“User Content”). By submitting User Content, you grant M&R Legacy Ventures LLC a worldwide, non-exclusive, royalty-free, sublicensable license to display, reproduce, distribute, and create derivative works from that content solely for the purpose of operating and improving the Service.

You represent and warrant that your User Content does not infringe any third party's intellectual property rights, violate any applicable law, or contain false or misleading information.

We reserve the right to remove any User Content that violates these Terms or that we determine, at our sole discretion, is harmful to the Service or its users.

You agree not to:

• Post false, misleading, defamatory, or harassing content
• Submit spam, automated content, or unsolicited commercial messages
• Impersonate another person or entity
• Attempt to reverse-engineer, hack, or disrupt the Service
• Scrape, crawl, or harvest data from the Service without our written permission
• Use the Service to collect other users' personal information
• Violate any applicable federal, state, or local law

Track data is provided for informational purposes only. We make reasonable efforts to verify listings, but we do not guarantee the accuracy of track hours, fees, status, access rules, or conditions. Track information can change at any time without notice.

Always confirm details directly with the track operator before traveling. Reliance on track data is at your own risk.

Track owners may subscribe to TrackFinder Pro for enhanced listing features. Subscriptions are billed on a monthly basis via Stripe, our payment processor. By subscribing, you authorize recurring charges to your payment method.

You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period — you retain Pro access through that date. We do not issue refunds for partial billing periods. We reserve the right to change Pro pricing with 30 days' written notice.

The TrackFinder USA name, logo, platform design, and original content are owned by M&R Legacy Ventures LLC and protected by applicable intellectual property laws. You may not use our trademarks, logos, or copyrighted materials without our prior written permission.

Nothing in these Terms grants you any right, title, or interest in the Service beyond the limited license to use it as described herein.

The Service is provided “as is” and “as available” without warranty of any kind, express or implied. We do not warrant that the Service will be uninterrupted, error-free, or free of viruses or harmful components. We disclaim all warranties of merchantability, fitness for a particular purpose, and non-infringement to the fullest extent permitted by law.

To the maximum extent permitted by applicable law, M&R Legacy Ventures LLC and its officers, members, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including personal injury, property damage, lost profits, or data loss — arising from your use of or inability to use the Service. Our total aggregate liability for any claim arising under these Terms shall not exceed the greater of (a) the amount you paid us in the twelve months preceding the claim or (b) fifty dollars ($50.00).

You agree to indemnify, defend, and hold harmless M&R Legacy Ventures LLC and its officers, members, and employees from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising from: (a) your use of the Service; (b) your User Content; or (c) your violation of these Terms.

We respect intellectual property rights. To submit a copyright infringement notice under the Digital Millennium Copyright Act (17 U.S.C. § 512), email legal@trackfinderusa.com with:

• Identification of the copyrighted work claimed to be infringed
• Identification of the infringing material and its URL on the Service
• Your name, address, and contact information
• A statement of good faith belief that the use is not authorized
• A statement under penalty of perjury that the information is accurate and you are authorized to act

These Terms are governed by the laws of the State of Washington, United States, without regard to conflict of law principles. Any dispute arising from these Terms or your use of the Service shall be resolved exclusively in the state or federal courts located in King County, Washington, and you consent to personal jurisdiction in those courts.

We may update these Terms at any time. When we do, we will post the updated Terms with a revised effective date. Your continued use of the Service after changes are posted constitutes your acceptance of the revised Terms.
